1. Agreement to Terms

By accessing or using the RevOasis website and services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use our Services.

2. Description of Services

RevOasis provides demand generation, marketing strategy, and related consulting services to B2B companies. Our services include but are not limited to:

• Fractional CMO and demand generation strategy
• Funnel and revenue system optimization
• ABM campaign creation and execution
• Marketing operations consulting
• Paid advertising, email, and lifecycle marketing
• Retention and expansion strategy

3. User Responsibilities

You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account
• Use our Services only for lawful purposes
• Not interfere with or disrupt the Services or servers
• Not attempt to gain unauthorized access to any portion of the Services

4. Service Agreements and Payments

Specific terms for our consulting and marketing services will be outlined in separate service agreements. These may include:

• Scope of work and deliverables
• Pricing and payment terms
• Contract duration and renewal terms
• Cancellation and refund policies

Unless otherwise specified in your service agreement, our services are provided on a month-to-month basis with 30 days' notice required for cancellation.

5. Intellectual Property

All content, features, and functionality of our Services, including but not limited to text, graphics, logos, and software, are owned by RevOasis and are protected by copyright, trademark, and other intellectual property laws.

Work product created specifically for you under a service agreement will be governed by the terms of that agreement. Unless otherwise specified, you will own the deliverables created for your business, while RevOasis retains the right to use general methodologies, frameworks, and learnings.

6. Confidentiality

Both parties agree to maintain the confidentiality of any proprietary or confidential information shared during the course of our engagement. This includes business strategies, financial information, customer data, and marketing plans.

7. Disclaimers and Limitations of Liability

No Guarantees: While we strive to deliver exceptional results, we cannot guarantee specific outcomes, revenue increases, or ROI. Marketing results depend on many factors outside our control, including market conditions, product-market fit, sales execution, and competitive landscape.

Services "As Is": Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied.

Limitation of Liability: To the maximum extent permitted by law, RevOasis shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

8. Indemnification

You agree to indemnify and hold harmless RevOasis from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of our Services or violation of these Terms.

9. Termination

We reserve the right to suspend or terminate your access to our Services at any time, with or without cause, with or without notice. Upon termination, your right to use the Services will immediately cease.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or our Services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

13. Entire Agreement

These Terms, together with any service agreements you enter into with us, constitute the entire agreement between you and RevOasis regarding the use of our Services.

14. SMS Messaging Terms

RevOasis may send low-volume conversational SMS messages to users, clients, prospects, or business contacts who have opted in or requested text follow-up. Messages may include booking links, appointment coordination, call follow-ups, requested business information, customer support replies, contract or invoice reminders, and other operational updates related to an active business conversation or service relationship.

You can opt in by requesting SMS follow-up during a phone call, submitting a website or booking form that includes SMS disclosure, or otherwise asking RevOasis to contact you by text in the course of an active business relationship. Consent to receive SMS messages is not a condition of purchasing any RevOasis service.
